Terms of Use
These Terms of Use govern your access to and use of this website, an independent news aggregator (the "Service"). Please read them carefully. They are a legally binding agreement between you and the operator of the Service.
By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
Acceptance of terms
By accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any additional guidelines or policies referenced here, including our Privacy Policy, our Advertising Disclosure, our Corrections policy, and our copyright and rights procedures.
We may modify these Terms as described in "Changes to these terms". Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Eligibility
The Service is intended for a general, adult audience. By using the Service you represent that you are old enough to form a binding contract under the law of your jurisdiction, or that you are using the Service under the supervision of a parent or guardian who agrees to these Terms.
The Service is not directed to children, and you may not use it if you are barred from doing so under applicable law.
Description of the Service
The Service is an independent, left-leaning news aggregator. Most items link out to, excerpt, or summarise reporting published by other outlets. Headlines, thumbnails, and media may be hotlinked from the original publisher, who remains the source and rights-holder of that material.
In addition to aggregated items, the Service publishes some of its own short "Daily Brief" summaries and longer "Explainers". The selection, arrangement, and commentary provided by the Service are offered for reference, context, and discussion, and do not imply endorsement of, or affiliation with, any linked outlet.
We may change, suspend, or discontinue any part of the Service at any time, including the availability of any feature or item, without notice or liability.
Acceptable use and prohibited conduct
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by, anyone else. You agree not to disrupt, overload, damage, or impair the Service or the networks and systems connected to it.
You must not attempt to gain unauthorised access to any part of the Service, its systems, or its data; probe or test the vulnerability of the Service; circumvent any security or access controls; or use automated means to scrape, harvest, or systematically download content except as expressly permitted by us in writing or by a machine-readable access policy we publish.
You must not use the Service to transmit unlawful, infringing, or malicious material, to impersonate any person or entity, or to misrepresent your affiliation with any person or entity.
Intellectual property and aggregated third-party content
The original material we create — including our Daily Brief summaries, Explainers, and the design, arrangement, and branding of the Service — is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, or redistribute it beyond what is permitted by law or by these Terms without our permission.
Aggregated content — the headlines, excerpts, thumbnails, and media associated with items that link to other outlets — belongs to the respective publishers and rights-holders, who remain the source of that material. We display it for the purpose of reference, commentary, and directing readers to the original reporting. Nothing in the Service transfers any ownership of that third-party material to us or to you.
If you are a rights-holder and believe your material has been used improperly, please see our Copyright complaints and Rights & Takedowns procedures.
Copyright complaints
We respect the intellectual property rights of others and respond to properly submitted copyright notices. If you believe material accessible through the Service infringes your copyright, please follow the process set out on our DMCA & Copyright Takedowns page, which lists the required elements of a notice and our designated agent.
Requests for removal or correction that are not formal copyright notices can be made through our Rights & Takedowns page.
Third-party links and content
The Service links to and displays material from third-party websites and publishers. We do not control, and are not responsible for, the content, accuracy, availability, or practices of those third parties. Links and excerpts are provided for convenience and reference and do not constitute an endorsement.
Your dealings with any third party, and your reliance on any third-party content, are solely between you and that third party. We encourage you to review the terms and policies of any site you visit through the Service.
Disclaimers
The Service and all content made available through it are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, completeness, timeliness, or reliability of any content.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any aggregated reporting is accurate, as the underlying reporting is created and controlled by other publishers. Any reliance you place on content from the Service is at your own risk.
Limitation of liability
To the fullest extent permitted by law, in no event will the operator of the Service, or its officers, contributors, or suppliers, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service or any content or third-party site accessed through it.
To the fullest extent permitted by law, the total aggregate liability of the operator for all claims relating to the Service will not exceed the greater of the amount you paid us, if any, to use the Service, or a nominal sum. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you; in that case, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless the operator of the Service and its officers, contributors, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Governing law and venue
These Terms, and any dispute arising out of or relating to them or the Service, are governed by applicable law, without regard to conflict-of-laws rules. Nothing in these Terms removes any mandatory consumer-protection right available to you in your place of residence.
We ask that you first contact us at hey@social-justice.news so we can try to resolve any dispute directly. Any dispute that cannot be resolved informally will be submitted to a court of competent jurisdiction, to the extent permitted by applicable law.
Changes to these terms
We may revise these Terms from time to time. When we do, we will update the effective date shown at the top of this page and, for material changes, take reasonable steps to make them prominent.
Your continued use of the Service after revised Terms take effect constitutes your acceptance of them. If you do not agree to the revised Terms, you should stop using the Service.
Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
Entire agreement
These Terms, together with the Privacy Policy and the other policies referenced in them, constitute the entire agreement between you and the operator regarding the Service and supersede any prior agreements on that subject. Our failure to enforce any provision is not a waiver of that provision.
